Introduction: The right of a military accused to a speedy trial is a concept which has generated a great deal of confusion. Although frequently litigated at the trial level, there is little ?horn book law? and a review of the cases tends to leave one with the impression that military appellate courts have continued to cite cases which appear to have been reversed by later decisions. Adding to this confusion is the existence of two distinct legal philosophies concerning an accused?s right to a speedy trial. One is the law developed by civilian courts, both federal and state, and the other is the law developed by military courts. The basic principles are similar, but their application to a particular set of facts varies greatly.
